Terms & Conditions

The following constitutes our terms and conditions of sale. For a summary in what we'd like to think is 'plain English', please scroll to the bottom.

1. Unless otherwise agreed in writing, these terms and conditions shall apply to all items sold by Help Empty My Attic.
2. Help Empty My Attic is a trading name of Jonathan Wingfield of Bradford, BD2 4QU
3. Prices stated on this site are correct at the time of writing, and form an invitation to treat.  Equally, items offered for purchase may also be made available elsewhere (e.g. eBay, toy fairs), and there may be a delay before availability on this site is updated.  A contract to fulfil an order will not be deemed to have been agreed until an invoice has been issued to the customer.
4. Our preferred method of payment is Paypal, though we are able to accept Cheques, Postal Orders and International Money Orders.  Orders will not be dispatched until cleared funds have been received (e.g. cheque has cleared).  Customers are reminded that all prices are in British Pounds Sterling (GBP).
5. We aim to dispatch orders within 2 working days of receiving cleared payment, however we do usually dispatch on a daily basis during the week and most orders are sent on on the day cleared payment is received.  Small items are normally sent via Royal Mail 1st Class Post or Small Packet Airmail, with larger or heavy items being sent by courier (usually Parcelforce or UPS).  Items over £30 in value will generally require a signature upon receipt.  We reserve the right to dispatch orders by the most cost effective method possible.
6. Purchases made via the Internet are covered by the Distance Selling Act.  This means that the customer may cancel a purchase within 7 days of receipt.  We will refund the sale on receiving the returned order in it's original condition.  Should an order be returned, we ask that we are notified in advance so that we can ensure that somebody is in to receive the package.  Customers are reminded that return postage is not refundable, and that they should ensure that the package is sent at their own risk (i.e. we can only refund an order if we receive it back).
7. All of our items are pre-owned.  As such they are 'sold as seen'.  We pride ourselves on our descriptions and any defects should be pointed out, but we are human and do make mistakes, so if you feel there is something that we have missed, please contact us as soon as possible so that we can try and resolve the issue.
8. Sometimes things occur that are beyond our control that may affect our ability to either fulfil an order, or fulfil it within our normal timescale.  Where this is the case, we reserve the right to suspend or cancel an order without liability.
9. We are members of the Market Traders Association, and as such have Public Liability Insurance.  Details of this are available on request.

Summary of Terms & Conditions

Basically, we try to be fair to all of our customers.  Most of the time the details regarding the prices, the product and so on are correct, but we are only human and we do make mistakes.  If we've made a mistake, we will admit it and will try our best to resolve any problems.  If a price is wrong, we may not be able to fulfil an order, but this is unusual and we do try to honour prices shown.  We do offer the items on this site for sale in other places, and sometimes there may be a delay in updating availability.  Where this happens, we will let you know by email that the item is no longer available, rather than sending you an invoice.  We send out orders most days during the week, though sometimes it isn't possible due to being away at sales or other events.  If we are unable to send an item out the same day, we aim to send it out the next working day.  Finally, if there is a problem with your order when your receive it, please contact us as soon as possible so that we can resolve the problem or arrange a return/refund if appropriate.
